Terms of Service

1. Introduction
Welcome to RENTSOFT ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the RENTSOFT platform, website, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
RENTSOFT provides a comprehensive property management platform that enables landlords, property managers, and tenants to streamline rental operations, including property listings, tenant screening powered by TransUnion, application management, and more—all completely free of charge.
If you do not agree to these Terms, you may not access or use the Services.
2. Eligibility
To use the Services, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction
- Have the legal authority to enter into these Terms
- Not be prohibited from accessing the Services under applicable law
- Provide accurate and complete registration information
By creating an account, you represent and warrant that you meet these eligibility requirements.
3. User Accounts
3.1 Account Creation. You may create an account as either a property manager/landlord ("Company User") or a tenant ("Tenant User"). You must provide accurate, complete, and current information during registration and keep your account information updated.
3.2 Account Security. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized access or use of your account.
3.3 One Account Per User. Each user may maintain only one active account. Creating multiple accounts may result in termination of all your accounts.
4. Services and Features
4.1 Free Services. All RENTSOFT features and services are provided completely free of charge to users. There are no subscription fees, monthly charges, or hidden costs for using the platform.
4.2 Tenant Screening. Our tenant screening services are powered by TransUnion Rental Screening Solutions, Inc. Use of screening reports is subject to the Fair Credit Reporting Act (FCRA) and our separate Company Terms and Consumer Agreement.
4.3 Screening Fees. While RENTSOFT services are free, tenants are responsible for paying a $30 application fee for comprehensive screening reports, which includes credit check, criminal background check, and eviction report.
4.4 Service Modifications. We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time, with or without notice.
5. Acceptable Use
You agree NOT to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Upload or transmit viruses, malware, or other harmful code
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Services
- Use the Services for any fraudulent or illegal purpose
- Scrape, copy, or download content using automated means
- Impersonate another person or entity
- Discriminate against any protected class under fair housing laws
- Use consumer reports for any purpose other than tenant screening for rental housing
6. Fair Housing Compliance
RENTSOFT is committed to supporting fair and equal housing opportunities. All users must comply with the Fair Housing Act and applicable state and local fair housing laws.
Protected Classes. It is illegal to discriminate in housing based on race, color, national origin, religion, sex, familial status, disability, or any other protected class under federal, state, or local law.
Property Manager Obligations. Property managers and landlords using our Services must:
- Apply consistent screening criteria to all applicants
- Provide required adverse action notices when denying applications based on screening reports
- Maintain documentation of rental criteria and application decisions
- Ensure all advertising and communications comply with fair housing laws
Violations of fair housing laws may result in immediate termination of your account and may be reported to appropriate authorities.
7. Intellectual Property
7.1 Our Rights. The Services, including all content, features, and functionality, are owned by RENTSOFT and are protected by copyright, trademark, and other intellectual property laws. The RENTSOFT name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of RENTSOFT.
7.2 Your Content. You retain all rights to content you upload or submit to the Services ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your User Content solely to provide and improve the Services.
7.3 Feedback. Any feedback, comments, or suggestions you provide regarding the Services may be used by us without any obligation to you.
8. Privacy and Data Protection
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Services, you consent to our data practices as described in the Privacy Policy.
8.1 Data Security. We implement reasonable security measures to protect your data, but we cannot guarantee absolute security. You use the Services at your own risk.
8.2 Consumer Reports. Consumer reports obtained through our Services must be handled in accordance with the FCRA, including proper disposal requirements under the Fair and Accurate Credit Transactions Act (FACTA).
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, RENTSOFT disclaims all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Warranties that the Services will be uninterrupted, error-free, or secure
- Warranties regarding the accuracy, completeness, or reliability of any content or information
- Warranties that defects will be corrected
No Legal Advice. RENTSOFT does not provide legal advice. The Services are tools to assist with property management but do not substitute for professional legal counsel.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RENTSOFT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability to you for any claims arising from or related to the Services shall not exceed $100 or the amount you paid us in the preceding 12 months (which, since our Services are free, would be $0).
These limitations apply regardless of the legal theory on which the claim is based, and even if we have been advised of the possibility of such damages.
11. Indemnification
You agree to indemnify, defend, and hold harmless RENTSOFT and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of any applicable laws or regulations
- Your User Content
12. Termination
12.1 By You. You may terminate your account at any time by contacting us or using the account deletion feature in your settings.
12.2 By Us. We may suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, including for:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Requests by law enforcement or other government agencies
12.3 Effect of Termination. Upon termination, your right to use the Services immediately ceases. We may delete your account data, though we may retain certain information as required by law or for legitimate business purposes.
13. Dispute Resolution
13.1 Governing Law. These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
13.2 Informal Resolution. Before filing any formal dispute, you agree to first contact us at legal@rentsoft.com to attempt to resolve the dispute informally.
13.3 Jurisdiction. You agree to submit to the personal jurisdiction of the state and federal courts located in Delaware for any disputes that cannot be resolved informally.
13.4 Class Action Waiver. You agree to bring any disputes in your individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.
14. General Provisions
14.1 Entire Agreement. These Terms, together with our Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and RENTSOFT regarding the Services.
14.2 Modifications. We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Effective Date." Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms.
14.3 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.4 Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
14.5 Assignment. You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
14.6 Third-Party Services. The Services may contain links to third-party websites or services. We are not responsible for the content, terms, or practices of any third parties.
