CONSUMER AGREEMENT FOR SHAREABLE SERVICES

General Terms

This Consumer Agreement ("Agreement") applies to your access to and use of TransUnion Rental Screening Solutions, Inc.'s ("TURSS") SmartMove® ShareAble tool ("ShareAble" or "Service"). By using the Service, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, you should not use the Service. TURSS reserves the right to make changes to this Agreement and reserves the sole right to interpret this Agreement.

Please read this Agreement carefully before using ShareAble. Please print a copy for your records. If you have any questions regarding these terms, please contact us through the links found on www.smartmove.com.

Disclaimers

By agreeing to the terms in this Agreement, you acknowledge and understand that: (1) by creating a profile or by using the Service, you are allowing prospective property owners and/or property managers to order a consumer report related to you; (2) the Service only permits you to provide a property owner and/or property manager with the information that you consent to being shared; (3) each property owner and/or property manager is solely responsible for complying with all laws applicable to their decision whether or not to engage in a transaction with you, including but not limited to the Federal Fair Credit Reporting Act, and you acknowledge that the Service is provided as-is and may not include all information necessary for the property owner and/or property manager to comply with all such laws; (4) ShareAble is not a tenant screening service; and (5) you may revoke consent and sharing at any time. However, TURSS cannot retrieve data that has already been provided to a property owner and/or property manager.

Registration

In order to use the Service, you must register for an account ("Account") and provide certain information about yourself as prompted. You represent and warrant that: (a) all required registration information you submit is truthful and accurate; (b) you will maintain the accuracy of such information. You may delete your Account at any time, for any reason, by following the instructions on the Service. TURSS may suspend or terminate your Account in accordance with the Section entitled, "Termination," below.

You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account. You agree to immediately notify TURSS of any unauthorized use, or suspected unauthorized use of your Account or any other breach of security. TURSS cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.

Privacy

TURSS cares about the privacy of its users. You understand that by using the Service you consent to the collection, use, and disclosure of your personally identifiable information and aggregate data as set forth in our Privacy Policy located at www.transunion.com/privacy, and to have your personally identifiable information collected, used, transferred to and processed in the United States.

Your Rights Under The Fair Credit Reporting Act

The Fair Credit Reporting Act (FCRA) promotes the accuracy, fairness, and privacy of information in the files of consumer reporting agencies. The Federal Trade Commission (FTC) enforces the FCRA with respect to consumer reporting agencies. Termination

You agree that TURSS, in its sole discretion, may suspend or terminate your Account (or any part thereof) or use of the Service and remove and discard any content within the Service, for any reason, including, without limitation, for lack of use or if TURSS believes that you have violated or acted inconsistently with the letter or spirit of this Agreement. Any suspected fraudulent, abusive or illegal activity that may be grounds for termination of your use of Service, may be referred to appropriate law enforcement authorities. TURSS may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this Agreement may be effected without prior notice, and acknowledge and agree that TURSS may immediately deactivate or delete your Account and all related information and files in your Account and/or bar any further access to such files or the Service. Further, you agree that TURSS will not be liable to you or any third party for any termination of your access to the Service.

Use of Service by Minors

The Service is not directed to individuals under the age of 18. TURSS does not knowingly collect personally identifiable information from children under 18. If a parent or guardian becomes aware that his or her child has provided us with personal information without their consent, he or she should contact us at smartmove@transunion.com. If we become aware that a child under 18 has provided us with personal information, we will delete such information from our files.

Applicable Law

You agree that: (i) the Service shall be deemed solely based in Pennsylvania; and (ii) the Service shall be deemed a passive one that does not give rise to personal jurisdiction over TURSS, either specific or general, in jurisdictions other than Pennsylvania. This Agreement shall be governed by the internal substantive laws of the Commonwealth of Pennsylvania, without respect to its conflict of laws principles. Any claim or dispute between you and TURSS that arises in whole or in part from the Service shall be decided exclusively by a court of competent jurisdiction located in Chester County, Pennsylvania.

BY CLICKING "I AGREE" OR BY ACCESSING OR USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO THIS AGREEMENT, YOU MAY NOT ACCESS OR USE THE SERVICE.
